Police for the community of Deming, New Mexico, are under investigation by the law enforcement board, and several doctors have been referred to the state licensing board, after putting drivers stopped for traffic infractions through hours of invasive medical procedures, including, a rectal exam, enema, and a colonoscopy.


The article describes not one but two men –  in two separate incidents – who have been subjected to what The New Civil Rights Movement sugarcoats as an “invasive search”, apparently performed in the name of drug searches. One of the victims, David Eckert, underwent a fourteen hour invasive search. After x-rays, two rectal exams, and enemas, they sedated him without his consent and gave him a colonoscopy. They knocked him unconscious and violated his body.

Invasive search? Bullshit. If this case turns out the way the media and Eckert’s attorney are telling it, this is was government-sanctioned rape.

Eckert’s attorney, Shannon Kennedy, said in an interview with KOB that after law enforcement asked him to step out of the vehicle, he appeared to be clenching his buttocks.  Law enforcement thought that was probable cause to suspect that Eckert was hiding narcotics in his anal cavity.  While officers detained Eckert, they secured a search warrant from a judge that allowed for an anal cavity search.

Government sanctioned rape, recommended by cops, OK’d by a judge and performed by doctors in the name of law enforcement and the war on drugs. The KOB4 website lists in horrifying detail all of the many ways the doctors abused the man. I wouldn’t recommend reading that unless you want to get good and pissed off.

This whole situation terrifies me. I’ve read a good many articles about police brutality, but this kind of methodical, multi-organization, coordinated abuse is so hard for me to wrap my brain around.

A lawsuit from David Eckert against…well, everyone…is pending.

      All “authorities” should be held to a higher standard than the public, and face stiffer punishment and longer sentences than you or I. They’re supposed to know the law and enforce it, so they should know better.

      Instead, the “authorities” (authoritarians is more like it) too often get a slap on the wrist. Remember the filthy “cop” in California who pepper sprayed students at UC Davis, an unprovoked assault on peaceful protesters? Did he get a long prison term? Was he fired?

      No. He got $38,000 of public money as worker’s compensation for “stress”.

      Good advice, Emily. I reread their recommendations every so often and it sounds like the key is sounding calm, confident knowledgeable about your rights. However, I have no idea if I could keep my head in a situation such as the one Mr. Eckert found himself 🙁

    Hmmm … lacking other healthcare options I’m thinking that I’ve put off having that prostate exam and colonoscopy long enough. I figure I can loosen my belt and rehearse my furtive movements before blowing through some stop signs in a high crime area.

    Thanks for this. I admit I hadn’t thought of this as rape until you’d said it, and none of the write-ups I’d read of this case called it rape either. But that’s what it is.

      None of the write-ups I read referred to it as rape either, even those by people who have worked in anti-rape activism, which I protested strongly. It meets the FBI definition easily (penetration of the anus without consent), and the general definition of violations of bodily autonomy that take on an extra dimension of humiliation or violation by virtue of the act or body part(s) being sexualized in some sense. This was state-mandated rape, plain and simple, and it’s actually not that uncommon a phenomenon, often operating under the euphemism “cavity search” (all of which should be banned by 4th Amendment prohibitions against unreasonable searches and seizures, as it explicitly affirms a right to bodily integrity).

    I didn’t believe that at first, but you’re right:

    After hosting the medical rape session, the Gila Regional Medical Center billed Eckert $6,000.00 for the trouble and is threatening to take him to collections if he doesn’t pay.

    In addition to that:

    Not only was the search warrant overly broad and lacking in probable cause, but it was also only valid in Luna County, where Deming is located and Eckert was arrested. The hospital where his anal probe took place is in the town of Gila, located in neighboring Hidalgo County.

    Additionally, the search warrant expired at 10 p.m., while doctors didn’t even begin prepping Eckert for the colonoscopy until 1:00 a.m. the following morning.

    So, they get a warrant based on butt-clenching and a dog that’s known for giving false positives. Despite the broad warrant, they still manage to violate it. They perform outrageously invasive procedures, repeatedly, and then they bill the victim for it. And to top it off, one of them gets promoted afterwards.

    You can’t make this shit up.

    Several things in the original article that make this particularly awful:
    1- The police relied on an uncertified K9 police dog as the sole reason they suspected drugs
    2- According to the article, the same K9 police dog also indicated drugs on someone else who was also invasively searched with nothing found
    3- The medical center that performed the tests on a completely unwilling subject at the sole discretion and insistence of the police is billing Eckert and threatening to use a collection agency.
